This Campaign is being organized by Pernod Ricard India Pvt. Ltd., a company duly incorporated under the Companies Act, 1956 and having its, registered office at: Atelier, No.10, Level 1, Worldmark 2, Aerocity, New Delhi – 37 (“PRI”), in association with its partner agency M/s Premier Sales Promotions Pvt. Ltd, a company duly incorporated under the Companies Act, 1956 and having its registered office at: No. 10/4, 4th Floor, Mithra Towers, First Block Kasturba Road, Bengaluru Urban, Karnataka - 560001, (“Agency”) hereinafter together referred to as “Organizers”.

 

Please read the terms and conditions of the Royal Stag Barrel Select Mega Campaign 2021 before participating in it (hereinafter referred to as the “Campaign”). By participating/ availing this Campaign, it is deemed that the participants/ customers/ consumers (hereinafter collectively referred to as “Participant”) and/or Winners have irrevocably and unconditionally accepted all terms & conditions contained herein, including any/all amendment, modification, etc. made thereto without demur and shall throughout remain bound to them as under:

 

  1. AGREEMENT TO TERMS AND CONDITIONS -

  1. By participating in this Campaign, Participants fully and unconditionally agree to abide by the Terms and Conditions available on www.rsbsgoldensurpise.com (“T & C Website”). Organizer’s decision shall be final and binding in all matters related to the Campaign is subject to all requirements set forth herein.

  2. Organizer reserves the right to exclude any person from the Campaign on grounds of misconduct or criminal record.

  3. Organizer reserves the right to terminate, modify or extend the Campaign, at any time at its absolute discretion, without assigning any reason or prior intimation to the participant.

  1. ELIGIBILITY & CAMPAIGN PERIOD -

  1. This Campaign is open only for Indian citizens above the Legal Drinking Age in their respective states, across select outlets in select cities of such states (‘State/s).

  2. Organizers’ employees, their family members, sponsors, agents, distributors, wholesalers, retailers and any other channel partners, including their employees or any outlet staff, bar staff and counter sales-men are not eligible to participate in the Campaign. Entries received from any of the foregoing ineligible participants shall be liable to be rejected by the Organizers at any stage of the Campaign without demur.

  3. The Campaign shall be conducted in 2 Phases. The States where this Campaign will go live in Phase-1, along with the Legal Drinking Age, Campaign Period and Missed Call Numbers are mentioned in TABLE-1. The States where this Campaign will go live in Phase-2, along with the Legal Drinking Age Campaign Period and Missed Call Numbers are mentioned in TABLE-2.

  4. The Campaign is open only between the Start date & End date (mentioned below), both days inclusive, for each Phase (“Campaign Period”).

  5. The Organizers reserve the right to change the Campaign Period without prior intimation to the Participant. Thereafter, Organizers will not be obligated in any manner whatsoever. Entries beyond the Campaign Period will not be considered valid for participation in the Campaign.

  1. HOW TO PARTICIPATE –

 

  1. This Campaign is applicable on all packs of Royal Stag Barrel Select Whisky (hereinafter “Product”). Stocks are available without the Campaign as well.

  2. To participate in the Campaign, Participants (during their respective Phase of the Campaign) can participate by giving a missed call on the numbers mentioned above in Table-1 and Table-2 (as applicable), which can be also found mentioned on posters and other points of sale materials deployed at the selected outlets in the respective State/s.

  3. After giving a missed call, Participants will receive a SMS with a microsite link. The Participant needs to agree that he/she is above the legal drinking age in his/her respective State and accept Terms & Conditions on the microsite.

  4. The Participant will then be required to enter his/her name and batch no. which can be found mentioned on the Product packaging and/or the bottle that has been purchased from the participating outlet and also answer a simple question on the microsite to register his/her participation.

  5. Upon entering the correct batch no and answering the question, Participant will receive an SMS confirming his/her participation and the Participant’s entry will be recorded.

  6. Participants sending the correct batch no. only will be considered eligible for the Campaign.

  7. Participants who have participated from States forming part of Phase 1 of the Campaign shall not be eligible to participate from States forming part of Phase 2 of the Campaign.

  8. The organizers shall not be responsible for (including but not limited to):

    • any SPAM generated messages.

    • the Operator Code not being displayed on the user’s mobile phone.

    • any SMS message delivery failure.

    • any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason.

    • If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign.

    • Other conditions beyond its reasonable control.

    • If the participant does not have a valid cashback or merchant account.

    • If the participant does not have the KYC on its cashback or merchant account.

 

  1. PRIZES-

 

  1. Daily Prize - Digital Promotional E-vouchers (Digital wallet cash back / OTT 3 months subscription / Rs. 500 e-commerce cash voucher):

 

  1. The Daily Prize(s) to be won during each Phase of the Campaign are as follows:

    1. Campaign Phase 1 – Minimum 92,200 lucky winners will be announced from the pool of Participants from list of Participating States in Table 1.

    2. Campaign Phase 2 – Minimum 8800 lucky winners will be announced from the pool of Participants from list of Participating States in Table 2.

 

  1. On sending the correct batch no. as mentioned on the Product packaging / bottle and post verification by the Organisers, the selected lucky participant will receive a digital reward code by SMS on his/her registered mobile number along with a web link to claim the reward within 24-48 hours (“Digital Promotional E-Voucher”). Winner(s) will be required to log on to the redemption link i.e., www.rsbs.bigcityexperience.com and redeem the E-Voucher(s) won after following due process.

 

  1. As part of the Campaign, minimum 1,50,000 lucky winners will win Digital Promotional E-Vouchers (Daily Prize) that can be either:

  • Rs. 10 digital wallet cashback, or

  • Rs. 20 digital wallet cashback, or

  • Rs. 40 digital wallet cashback, or

  • Rs. 50 digital wallet cashback, or

  • Rs. 100 digital wallet cashback, or

  • 3 Months OTT service subscription, or

  • Rs. 500 e-commerce gift voucher.

  1. The Winners will be selected by way of a computer-generated automatic randomizer software. Such Winners shall be informed by SMS on their respective mobile numbers from which they have participated. In the SMS there will be an E-Voucher code along with the redemption link and the E-Voucher shall then be redeemable by following the instructions given in the link. Winners shall not be entitled to seek any replacement / exchange against the Prizes that they have received.

 

  1. The redemption link to claim the E-vouchers shall be valid for a period upto the end date of the respective Campaign Period in each Phase. Under any circumstance there will be no claim against the Organizers should the winner not redeem the same within the specified period and/or due to reasons stipulated in clause 3(viii) above.

 

  1. A Participant can participate any number of times during the Campaign Period (in each Phase) using the same mobile number. However, for the purposes of the randomizer, only one (1) entry per day per mobile number shall be considered. Further, Participant(s) can only be gratified once during the day and upto a maximum of three times per mobile number during the respective Campaign Period under each Phase.

 

  1. Validity of E-vouchers shared for OTT subscription or gift voucher will be 3 months from the date of redemption. Also, these codes will be redeemed as per the respective platform’s terms & conditions. The Organisers hold no responsibility in case of non-redemption of vouchers for any reasons specified below or if the E-voucher is redeemed beyond the validity period.

 

  1. Digital Wallet Cashback –

 

In addition to missed-call based participation, states in Campaign Phase-2 (Delhi, UP) will also win assured purchased-link digital wallet cashback coupons. Those coupons will be given on purchase of any of the Royal Stag Barrel Select SKUs at the store.

 

The Phase-wise eligibility of digital wallet cashback and the respective cashback value are enumerated below:

  1. Mega Prize – Rs. 5000 gift digital e-voucher for partner site (Kalyan Jewelers):

 

  1. As part of the Campaign, a total of 1000 lucky winners from the entire pool of Participants in the States will be chosen by the Organizers, who shall win one (1) Rs. 5000 gift voucher each for partner merchant site i.e. Kalyan Jewelers. The Winners will be selected by way of a randomizer software in the presence of an independent auditor. The Mega Prize would include any applicable gift tax (As per Income Tax Law of Govt of India).

  2. The Mega Prize(s) to be won during each Phase of the Campaign are as follows:

    1. Campaign Phase 1 – Total 640 lucky winners will be announced from the pool of Participants from the list of Participating States in Table 1.

    2. Campaign Phase 2 – Total 360 lucky winners will be announced from the pool of Participants from the list of Participating States in Table 2.

  3. The winners will be announced on a weekly basis during the Campaign Period of each Participating State(s) in the respective Campaign Phase.

  4. The winners of the Mega Prizes will be chosen out of the pool of entries received during a particular week, and shall be not be carried forward for the purposes of the draw(s) in the subsequent week(s).

  5. In terms of delivery of the said Prize, the chosen winner for the Mega Prize will be contacted by the Agency for KYC verification. This shall, however, in no manner be construed as a communication for being a Winner of the Campaign. In the event, the winner is not reachable after 3 attempts, his/her claim to the Mega Prize would be considered to be forfeited and the Organizers shall be free to choose an alternate winner.

  6. If the winner is successfully contacted by the Agency, the Agency representative / executive will request the following list of identifying documents from the winner: ID Proof, Address Proof, Aadhar Card & Pan card (for Gift Tax wherever applicable). Documents need to be submitted within 72 hours of the call, else the claim would be forfeited, and alternate winner will be chosen. In event of documents being received on time, internal QC of documents shall be undertaken & once the winner is verified, Agency will issue a digital voucher code via Email & Mobile number to all the winners, which can be redeemed on partner website or offline stores.

  7. Eligible Participants during the respective Phase of the Campaign (including winners of the Daily Prizes) can win the Mega Prize only once during the Campaign Period, for that Phase.

  8. Note: Aforesaid Prizes shall be handed over to the respective Winners post KYC verification within 45 days. The KYC verification will be done via a call to the winners by the Organizers. The Winners will then be required to send their PANCARD and AADHAR Card softcopy as well as complete current residential address via email to the Agency on win1@bigcity.in for the purposes of completing their verification. The Winners will then receive the Gold E-vouchers on their registered Email ID.

  9. The winner(s) of the Mega Prize(s) will be required to send the aforesaid documents via email within 72hours post receipt of the verification call by the Agency. Winner can be disqualified for not being able to complete KYC verification in this stipulated time.

  10. In addition to the above, Participants may be asked to submit additional documents as deemed necessary for verification & prize allocation.

 

  1. INTELLECTUAL PROPERTY-


 

  1. All rights, title and interest, including but not limited to the Intellectual Property Rights, in the Campaign material(s) and in any and all responses received shall vest solely and exclusively with PRI at all times. PRI or any person or entity permitted by PRI in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Campaign, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

  2. All material submitted in connection with the Campaign (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to PRI upon submission and become the property of PRI exclusively. PRI may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of PRI.


 

  1. GENERAL CONDITIONS-

  1. The Participant understands and agrees that the selected Winner(s) alone shall be entitled to the prizes, subject to all terms and conditions mentioned herein, and furnishing of correct and complete details as required by the Organizers (including but not limited to) in the prescribed manner and to the entire satisfaction of the Organizer.

  2. The Campaign will be promoted at the sole discretion of the Organizer.

  3. Organizer will select and announce the selected Winner/s as per the terms set out in Clauses 3 & 4 above. The Winners will be intimated on the registered mobile number from which they had participated in the Campaign. The decision of the management of Organizer in this regard shall be final & binding upon the Participant and/or the Winner(s), and the Participant/ Winner(s) hereby agree that no claims, disputes, etc. of any sort shall be raised against the Organizer

  4. The prize can neither be exchanged nor redeemed for cash/ any non-monetary consideration nor it is transferable.

  5. The prize is subject to the applicable laws of India. The prize would be delivered/ handed over to the Winner only upon proper identification and verification of the Participant to the full satisfaction of the Organizer. All Winners shall be duly required to provide a copy of their PAN card and other satisfactory identity proofs mentioned above.

  6. While accepting the Prize under the Campaign, the Winner(s) shall be required to execute an “indemnity and release of claims” form as may be provided by Organizer, as the case may be, which shall release the Organizer of all liability, loss, damage, demand, claim, etc. in connection with the Campaign and prizes contemplated under this Campaign. Failure to complete and sign any documents requested by Organizer may result in disqualification of such Participant and/or Winner. Thereafter, the Organizer, at its discretion, will be entitled to choose the next winner. All decisions of Organizer shall be final in this regard.

  7. Organizer is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Campaign is provided on "as-it-is" basis without any warranty of any kind. Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. or any of its sponsors/ partners make no representations, and further disclaim themselves from all express, implied, and statutory warranties of any kind towards the Participants, Winners and/or any third party with respect to accuracy, timelines, completeness, merchantability, or fitness of the Campaign.

  8. Organizer shall provide the prize on "as-it-is” basis without any warranty or guarantee (whether express or implied) regarding the prize covering its quality, suitability, merchantability or its fitness. The Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. disclaims itself from all liabilities, including but not limited to, those arising due to any deficiency/ defect in the Campaign and/or prize and for any consequential damages/ losses arising with respect to the Campaign and/or the prize.

  9. Organizer reserves its right to select and declare or not to declare the Prize Winner if the number of entries submitted for the Campaign is not up to the logistical satisfaction of the Organizer. Decision of Organizer in this regard shall be final & binding, and no correspondence in this regard shall be entertained.

  10. All rights, title and interest, including but not limited to Intellectual Property Rights in the Campaign and/or any other promotional material(s) shall vest solely and exclusively with Organizer at all times. In connection with the Campaign, the Organizer or any person or entity permitted by the Organizer shall be entitled to use personal details of Participant and/or Winners such as names, characters, photographs, voices, videotape, etc. for any media promotions, marketing activity, publicity and likewise purposes. By voluntarily participating in the Campaign, Participant and/or Winner(s) hereby waive off all their rights to claim royalty, remuneration or legally challenge due to any such use of their personal details by the Organizer.

  11. Organizer reserves its right to change, defer, alter or cancel this Campaign in part or full, or change any or all terms and conditions of the Campaign, without giving any prior intimation/ notice of any kind. Further, it shall not be liable for any consequential losses/ damages to any Participant and/or Winners in this regard. Decision of the Organizer in general, and with respect to this Campaign in particular shall be full, final, binding and non-contestable upon the Participant and/or the Winners.

  12. Nothing contained herein amounts to a commitment or representation by the Organizer to conduct further likewise Campaign or schemes.

  13. Under no circumstance the Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. shall be liable to the Participant, Winners and/or any third party for any loss of profits or lost opportunity, or for any indirect, special, consequential, incidental, or punitive damages whatsoever, even if Organizer has been advised of the possibility of any such damages. The Participant/ Winners specifically agree not to file and/or initiate in person or through any family member or through any third party, any criminal and/or civil proceedings/ complaints/ applications in any courts or forum in India against Organizer, its management, directors, employees, officers, affiliates or subsidiaries, agents, representatives, etc. to claim any damages for any losses or seek relief in connection with the Campaign and/or the prizes. The Participant/ Winners specifically agree that Organizer, its affiliates, its group companies, their employees, officers, directors or any other person and/or sponsors shall not be responsible for any claims/ liabilities/ losses (including legal fees) arising out of and in relation to any injury/ damage/ harm/ loss/ death/ mental or emotional trauma suffered by the Participant or prize Winners in any manner whatsoever in connection with the Campaign and/or the prizes.

  14. Organizer shall not be liable to perform any of its obligations under the Campaign or in respect of the Prize where it is unable to do so as a result of unforeseen circumstances, Force Majeure conditions such as epidemic outbreak, pandemic including but not limited to COVID-19, lockdown or circumstances beyond its reasonable control. This Campaign is subject to promotional availability and government regulations including lockdown restrictions caused due to the pandemic.

  15. Organizer is empowered to take a decision in case of any conditions, circumstances and scenarios beyond these terms and conditions of the Campaign.

  16. The Campaign and the terms and conditions herein shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Campaign and/or prizes are subject to the exclusive jurisdiction of the courts at Delhi only. The Campaign shall be deemed void, where prohibited by law.
